2.1 When are these Terms of Sale applicable?
These Terms of Sale apply to all offers and contracts relating to the sale and delivery of products by Be Dodge. In other words, you agree to these Terms of Sale when you (i) place an order on our Website  Be Dodge  or (ii) on any other page directly associated with our Website (together, "Website") or when you accept an offer from Be Dodge. Any deviation from these Terms of Sale is only possible after written agreement from Be Dodge.
2.2 Products
Be Dodge has several types of products. This may include products designed entirely by  Be Dodge, which means designed and created entirely by  Be Dodge  (“Standard Products”) - and products which, although designed by  Be Dodge, can be personalized or modified by you by choosing materials or colors to your liking  (“Custom Products”), jointly referred to as Products.
You can customize products designed by  Be Dodge. Personalizing it means, for example, adding your favorite player's name and number (subject to permission), yours, your pet's, or whatever you want (as appropriate). Choose a player and his number, or add your own text and the number of your choice.
In addition, you can modify or design your own Product  Be Dodge  by choosing your own colors and in some cases your own materials. Likewise, you can add your name, your number as well as a crest or a flag.
2.3 Requirements for entering into a contract with Be Dodge
You must be 16 years of age or older to purchase products from our Website.
You can only order from our Website if you are a consumer, not a reseller.
You warrant that the information you provide to  Be Dodge  when requesting or ordering is precise and complete.
2.4 Conclusion of your contract
2.4.1 Formation of a contract related to Standard Products
All the information on the Website is indicative only. This means that the information does not constitute an offer to sell or a binding contract. You agree that your order constitutes an offer to purchase the products listed in your order.
Be Dodge reserves the right, at any time, to check an order in advance or to refuse it without indicating the reason, without liability. Your order will be deemed refused if  Be Dodge  does not confirm it within ten working days.
All your orders are subject to Be Dodge approval. We reserve the right, at our sole discretion, to refuse your order. The following are examples of the reasons why we may refuse your order:
(a) If any products shown on the Website are not available;
(b) If we are unable to obtain authorization for your payment;
(c) Whether delivery restrictions apply to a product;
(d) If any products presented on the Website contain a manifest error such as an incorrect displayed price or an incorrect description.
Once your order has been placed, we will send you an order confirmation email with your order number as well as the details of the products you have ordered from us and delivery information, unless your order is for Custom Products as indicated in point 2.4.2 below.  The acceptance of your order and the formation of a contract for the sale of the Standard Products between you and  Be Dodge  cannot be concluded without and until:
(i) either, you receive an email from Be Dodge confirming the shipment of Standard Products from our warehouse,
(ii) either, you have received a confirmation from the carrier informing you that you can proceed with the withdrawal of the standard Products if you have chosen the option of withdrawal of the standard Products in a store  Be Dodge  or a carrier's collection point, or that the carrier has stored the Standard Products at a collection point,
(iii) either, you have received a communication from Be Dodge confirming that the standard Products are ready to be collected in the store  Be Dodge that you have selected, in case you have chosen to pick up the Standard Products in a store  Be Dodge.
Please note that the option of withdrawal in store or at a carrier  Be Dodge  is only available in selected countries and in stores  Be Dodge  or collection points of identified carriers. 
2.4.2 Formation of a contract related to Personalized Products 
Once your order of personalized Products (including products  Be Dodge) passed, we will send you an order confirmation email. The acceptance of your order and the formation of a sales contract for personalized Products between you and  Be Dodge  will be complete when you receive the order confirmation message from Be Dodge.
2.5 Retention of title clause
The delivered products remain the property of Be Dodge until you have fully satisfied your payment obligations under the contract, including the payment of costs, even in the event of prior, late or partial deliveries. You are strictly prohibited from selling, destroying or obstructing the products before ownership of them has passed to you.
2.6 Product quality and maintenance
It is possible that different image acquisition and display technologies, or other technical reasons, cause small differences in color or the like with the products.  Be Dodge  cannot be held responsible for the aforementioned modifications and differences.
Be Dodge draws your attention to the washing and maintenance instructions on the product labels.  Be Dodge  cannot be held responsible for any damage resulting from improper treatment of the products, or resulting from a treatment not in accordance with these instructions.
2.7 Order cancellation
As we process your order upon receipt of it, it is not possible to cancel it.

2.8 Prices
The prices indicated are inclusive of VAT. The prices are expressed in euros (EUR).  Be Dodge  reserves the right to make price and product changes prior to your order.
Be Dodge reserves the right to modify, limit or terminate, at any time, a special offer or a reduction.
Be Dodge charges delivery costs. These delivery costs vary according to the Products and types of shipment. 
For more details on the charges applied,  the costs are specified in the shopping cart page. If applicable,  Be Dodge  will charge these fees separately. They will then be indicated and added to the total amount of the order.
2.9 Payment methods
The preferred payment methods available are cash, postal and bank checks as well as transfers. We can  also  accept, subject to reservations, payments by administrative money order.
Be Dodge  reserves the right to refuse certain payment methods.
2.10 Billing
When we issue or make available an invoice, or are required by law to do so,  Be Dodge  reserves the right to establish or make available dematerialized invoices and you accept this form of invoicing.
2.11 Specifics relating to personalized products 
To personalize your products, you can add your own text. For example, you can add your name, choose a player and a number or let your imagination run wild. Please respect the rules of decency, we reserve the right to refuse inappropriate terms and brand names. Please also note that some writing characters are not workable by our system.
We urge you not to use, upload, submit, copy or make public any names, words or expressions which:
- evoke or contain the name of a product, a service, a company, an organization or an event which does not belong to you;
- evoke or contain the name or nickname of a famous person (living or deceased);
infringe or could infringe third-party trademarks or other intellectual property rights;
- constitute a threat or incitement to violence or are defamatory, obscene, discriminatory, subversive, sexually explicit or unlawful in any way.
Be Dodge reserves the right to refuse any name, word or expression (or combination of these elements) falling within the categories mentioned above or which it deems unacceptable. This will then result in the cancellation of your order.
Please note that for any order of Personalized Products, you:
- declare and certify that no name, word or expression that you use, upload, submit, copy or make public in connection with the manufacture of your personalized Product does not fall into any of the aforementioned categories;
- agree to indemnify and continue to indemnify  Be Dodge for all costs, expenses, damages, losses and liabilities incurred or suffered by  Be Dodge  because of the use of a name, word or phrase that you have used, uploaded, submitted, copied or made public (or that appears on your personalized Product);
- grant to  Be Dodge  the non-exclusive, irrevocable, royalty-free and fully sublicensable worldwide right to dispose, reproduce, disclose or modify the names, words or expressions submitted during your order.
Insofar as the order concerns products manufactured or modified according to the customer's requirements, therefore personalized Products, no reflection period and no right of withdrawal, termination or return can then be granted.
2.12 Delivery
Be Dodge will deliver to the address you have indicated in mainland France and Monaco.  Be Dodge  can only deliver to a private or office address via La Poste and its Colissimo service.
Deliveries are made on working days. Public holidays in your country or in the region where the warehouse is located are therefore excluded.  Be Dodge. Please therefore consider any French national holiday as a non-working day. We advise you to consult the Holidays to be able to correctly estimate the delivery times.
For more information on delivery times, please see the specifics  of the Colissimo service on the La Poste website . Please note that delivery times are indicative and therefore should not be considered as firm deadlines. Simply exceeding the delivery time does not entitle you to any damage and interest. .
Please note that the deadlines for Custom Products are different. Adding text to a product takes time. Thus, delivery of your entire order of Standard Products and Custom Products will require up to three additional days. We also need to draw your attention to Personalized Products.  Be Dodge  which will be delivered separately from all other products within approximately 4-6 weeks. Be Dodge reserves the right to make a delivery in several times within reasonable limits, so that you get the products ordered as quickly as possible. You will not be charged any additional costs for such deliveries in several installments. However, if you have requested that Be Dodge make the deliveries in installments,  Be Dodge  reserves the right to charge you additional delivery costs. Each separate delivery will constitute a separate sales contract. In the event of late delivery by  Be Dodge  of part of an order or in the event of an error with regard to a separate order, no right to cancel another separate order will be granted to you.
Yes  Be Dodge  notes, prior to the conclusion of the sales contract, that the Products ordered can no longer be delivered,  Be Dodge  can then offer you a product of equivalent quality, price and use. You are under no obligation to accept the replacement product. If you wish, you can return it free of charge to  Be Dodge  within 30 days (your rights of withdrawal and return of course remain unchanged).
In the unlikely event that  Be Dodge  notes, after the conclusion of the sales contract, that the products ordered can no longer be delivered and that it is not responsible for them,  Be Dodge  will then be entitled to terminate the sales contract.  Be Dodge  will of course notify you immediately and reimburse you for all payments already made.
2.13 Return of products
  If your order does not give you complete satisfaction, you can exercise your right of withdrawal. This means that you have the right to return Standard Products as mentioned below for a refund. You just need to follow the instructions given in the next section:
Under the provisions of these Terms of Sale, you may return the standard Products delivered without specifying the reasons within 30 days from the day of receipt. If you wish to terminate the sales contract concluded with  Be Dodge, simply return the Standard Products to us. You can also use the withdrawal form made available to you (optional)  on demand . In all cases (with or without withdrawal form), you must follow the instructions set out in section 2.14 below.
If the return is made after this period, or the item has been worn or damaged, or is not in its original packaging,  Be Dodge  will not be able to accept returned items and will not be able to process a refund. Returned garments will only be accepted if the original tag / fabric has not been removed.
Please note that Customized Products  Be Dodge  are subject to special treatment insofar as they are created especially for you. We therefore cannot accept returns, except in the event of a manufacturing defect. For any questions regarding the return of defective Custom Products purchased online on our Website,  address  us a request via  our contact form .
Please follow the instructions in 2.14. All returned packages must be shipped using the carrier's return label or other label that allows the package to be tracked. We are not responsible for any packages lost or sent to the wrong address.
Products, unused and complete, must be returned, if possible, with their original packaging to:

If the return complies with these Terms of Sale,  Be Dodge  will refund the sale price and delivery costs paid (in the case of a complete return), as soon as possible after being notified of your wish to exercise your right of withdrawal. It is understood that Be Dodge will only be required to refund after receiving the returned products.
The transit time for your return is not up to us, but once your return has been received, we will process your request as quickly as possible. Therefore, it takes at least fourteen days for the receipt and processing of your package.  Be Dodge  will issue the refund within two days of processing your return, however, your bank may require additional time to process your refund and credit it to your account. We will notify you via email once the returned product (s) have been received and processed. We will refund the full amount of the product (s). Refunds will be made with the same payment method used for the original purchase.
If a standard Product is returned and  Be Dodge  believes that it has been damaged due to your action or negligence,  Be Dodge  reserves the right to deduct from the amount to be returned to you the loss of value caused by the damage to the returned product. You can avoid this consequence by not using the product and by refraining (as far as possible) from any action that could adversely affect its value.

2.14 Instructions for returning standard Products:
Please follow the next steps. .
1. Send us your request for the return form by email to  bedodgefrance@gmail.com  or via this  Contact form.
2. PRINT the  return form.
3. PLACE the products in their original packaging with the return form in the package.
4. CLOSE your package.
5. ADDRESS your package to Be Dodge - 10 rue Théophile Hingre   95440 Ecouen - FRANCE
6. DROP off your package at your post office.
Personalized products are designed especially for you and that is why we are unable to accept returns except in the event of a manufacturing defect.
2.15 Instructions for returning personalized Products
As explained above, Be Dodge Custom Products are created especially for you, so we only accept returns in the event of a manufacturing defect. If your product is defective, please refer to 2.14.
2.16 Exchange policy
Be Dodge can trade in products. If you want to exchange a product, you will need to return your order to get the exchange.  Be Dodge reserves the right to refuse the exchange  in accordance with our Return Policy.
2.17 Damaged or defective products
For  Be Dodge, quality is essential. We thoroughly test all of our products in real world conditions to ensure they are able to withstand the uses for which they were designed. It is extremely rare for our products to be damaged or defective. Please also note that Be Dodge has a legal obligation to ensure that the products comply with the sales contract or do not contain hidden defects.
When you act within the framework of the legal guarantee of conformity, you have a period of two years to act from the delivery of the product (s), you can choose between repair or replacement of the product (s). If the problems were not caused by the quality of the materials or the assembly process, the original product will be sent back to you. We do not refund products:
- obtained through a means other than our Website
- damaged as a result of abuse or neglect (exposure to chemicals, corrosive substances, open flame, high temperature, sharp object, resin, outdoor use etc.)
- damaged as a result of improper use or uses other than those intended (use of running shoes for field sports or hiking shoes as work shoes, etc.)

2.18 The interest rate for late payment penalties due on the day following the settlement date appearing on the invoice is equal to three times the legal interest rate applied by the European Central Bank to its most recent refinancing operation increased by 10 percentage points.
2.19 The amount of the lump sum indemnity for recovery costs in the event that the sums due are paid after the date of payment, payable without a reminder being necessary, is set at 40 euros.

If any provision is found to be void or otherwise unenforceable, that provision may be separated from the other provisions of these General Conditions and shall not affect their effects.
4.6 Subcontracting and attribution
Be Dodge  reserves the right to subcontract, transfer, assign or give in novation all or part of our rights and obligations subject to the General Conditions  Be Dodge  insofar as your rights conferred by the General Conditions  Be Dodge  are not affected. You are not permitted to subcontract, assign or transfer any of your rights and obligations subject to the General Conditions  Be Dodge  without our written consent.
4.7 Events beyond our control
Be Dodge  cannot be held responsible for any delay in execution or failure to fulfill our obligations under these General Conditions  Be Dodge  if the delay or failure is due to a cause outside the will of Be Dodge  .
4.8 Applicable law and competent jurisdiction
General Conditions  Be Dodge   are governed by the legislation of France.
French law applies to the sales contract, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
You and  Be Dodge  you hereby submit to the non-exclusive jurisdiction of the French courts.
4.9 Battery information
Batteries may be used in some of the products sold by  Be Dodge  .
Conventional batteries and rechargeable batteries containing hazardous substances are clearly identified by the symbol representing a crossed-out waste container. The chemical names of such hazardous substances may be given under this symbol. For example (Pb) for lead, (Cd) for cadmium and (Hg) for mercury.
Their disposal with ordinary household waste is prohibited by law. You can return your used batteries to a collection point or to an authorized store. The discount is free. You also have the option of returning purchased batteries and rechargeable batteries (without devices) to us after use. Please make sure you have sufficient postage on your shipment.
